RE: Appeal to the Ministry of Education Re2ardin Inequities in Transportation Funding
Trustee Laws has given notice that he will move as follows at the Board meeting on 12
September 2006:
WHEREAS the Education Act (Legislative and Municipal Grants) in part, outlines the following key
funding principles:
i) in section 234(1), "the Lieutenant Governor in Council (i.e., the cabinet of the government of
the Province of Ontario and /or essentially the Minister of Education) may make regulations
governing the making of grants for educational purposes,"
ii) in section 234(2), "regulations made under subsection (1) shall ensure that the legislation and
regulations governing education funding operate in a fair and non - discriminatory manner ",
iii) in section 234(2)(a) specifies that the fairness and non - discrimination in funding specifically
applies "as between English - language public boards and English - language Roman Catholic
boards"
THEREFORE BE IT RESOLVED,
A) THAT the OCDSB contact the Ombudsman for Ontario, the Ontario Human Rights Commission,
and the Lieutenant Governor with a cc to the Premier and the Cabinet of the Province of Ontario to
advise them that it is the opinion of the Ottawa - Carleton District School Board that with regards to
several aspects of the current levels of education funding in Ontario, the Ministry of Education has
(over a period of several years) failed in its obligations and responsibilities under the Education Act
to provide transportation as well as other funding in a "fair and non - discriminatory manner" - both
between similarly sized English - language public boards and between English - language public and
English - language Roman Catholic boards, and
B) THAT the Ottawa - Carleton District School Board request in writing, the immediate creation and /or
release of regulations around equitable transportation funding, that do not financially or service -
wise advantage & /or disadvantage one board over another, and
C) THAT the Ottawa - Carleton District School Board begin to work in partnership with other boards,
parents and students to pursue the potential for proceeding with legal action in the courts, should
the government of Ontario also fail to undertake the necessary actions to begin to equalize a badly
outdated provincial education funding formula, as was first identified in the Rozanski Report:
Investing in Public Education: Advancing the Goal of Continuous Improvement in Student
Learning and Achievement, Ontario (December 2002) and most recently reiterated in the
Investigation Report to the Minister of Education Province of Ontario Regarding the Dufferin -Peel
Catholic DSB (April 2006).
