HUMAN RESOURCES COMMITTEE To the Board 1 June 1998 A meeting of the Human Resources Committee was held on the above date in the Trustees' Committee Room, 133 Greenbank Road, Nepean, commencing at 7:30 p.m., with Trustee Lam in the Chair and the following also in attendance: MEMBERS: Trustees Sheryl MacDonald, and Pam Morse ALSO PRESENT: Trustees Albert Chambers, Jim Libbey, and Lynn Scott STAFF: Carola Lane, Director of Education & Secretary of the Board Michael Clarke, Superintendent of Business/Treasurer Ross Donaldson, Superintendent of School Services Barbara Stollery, Superintendent of Program and Information Technology Jim Vair, Superintendent of Human Resources Janet Beer, Labour Relations Officer Janice McCoy, Labour Relations Officer/Legal and Corporate Affairs Advisor Carol Murphy, Administrator of Labour Relations Cathy Kavanagh, Board Reporter NON - VOTING Lee Davidson, OCEPA REPRESENTATIVES: Sue Johnson, OSSTF - Support Staff Geoff Sheppard, OCETF Larry Capstick, President - OSSTF District 43, Wendy Bolt - OSSTF, Michel Auclair - Teacher, and Irmela Murphy, Principal Colonel By Secondary School were present for a portion of the in camera session. Approval of the Agenda On a motion by Trustee Sheryl MacDonald the agenda was approved, subject to moving Provincial Collective Bargaining from the in camera agenda to the public session for information. The Chair indicated that highlights of the Paroian report, the responses of the former CBE and OBE may be discussed and questions entertained, however, specifics relating to the OCDSB must be dealt with in camera. 2. Public Ouestion Period Sue Johnson, OSSTF - Support Staff, recommended that consideration be given to awarding sick leave gratuities to former OBE employees on an equal basis with former CBE employees. The Chair advised that this will be discussed during the in camera session. Sue Johnson asked if two identical positions exist in a department as a result of amalgamation, and one position is declared redundant and the other employee is granted an EDP, whether a vacancy will be created in another department to fill the void. Superintendent Vair advised that senior administration is currently addressing this situation and noted that it is not efficient practice to fill a vacancy from outside a department in another bargaining unit. In response to a question from Sue Johnson, the Director indicated that support staff will be displaced and training requirements will be addressed. Human Resources Committee (Open) 1 1 June 1998 M On behalf of OCETF, Geoff Sheppard congratulated the Board on approving the budget and enquired when layoff notices will be rescinded. Superintendent Vair advised that this is a priority and the process will commence within the next several days. Policies re: Workplace Safety and Insurance and Health and Saft Your committee had before it a staff Report No. 98 -196 requesting approval of policies for Workplace Safety and Insurance and Health and Safety. Sue Johnson enquired if the Joint Health and Safety Committee will continue. Superintendent Vair advised that representation on the committee will be maintained from each of the former Boards' employee groups until the groups are merged, which he anticipates will be in the fall. At that time, a representative from each of the combined employee groups will continue on the committee as required by legislation. In response to a question regarding the word `requiring" in paragraph 2.2, of the Health and Safety Policy, it was noted that the ultimate responsibility belongs to senior staff, however, not all decisions are required to be made by them. It was therefore, suggested that the words "which may require" be substituted. Clarification was also provided with regard to the words "representative organization" in paragraph 2.4 e) and it was agreed that "representative or committee" be inserted. On a motion by Trustee Morse, your committee recommends: THAT BOARD POLICY P.054.HR: WORKPLACE SAFETY AND INSURANCE BE _ APPROVED. (Annex 1) 2. THAT BOARD POLICY P.058.HR: HEALTH AND SAFETY, AS AMENDED IN COMMITTEE, BE APPROVED. (Annex 2) 4. Provincial Collective Bar ag ining Superintendent Vair explained that the former CBE and OBE have, in the past, considered the concept of provincial collective bargaining and made submissions to the Ministry and to Leon Paroian regarding their positions. As Boards no longer have the ability to raise funds locally and therefore, do not have the power to generate their own revenue and are dependent on the province, the question arises as to whether the province should assume some responsibility in the form of collective bargaining. The Chair advised that at its Annual General Meeting, OPSBA will be considering a resolution in connection with provincial collective bargaining. Trustee Scott asked if the Paroian report addressed the issues raised by the predecessor Boards as she has been unable to find any recognition of their concerns in the report. She noted that the CBE examined the issue of provincial collective bargaining specifically from the point of view that the responsibility for collective bargaining is directly related to the responsibility for levying taxes. The Director clarified that the OBE's submission to Leon Paroian indicated that whoever has financial control should also have responsibility for collective bargaining. Superintendent Vair indicated that he will review the document for this specific information. Trustee Scott noted that several examinations/surveys have been conducted by various groups and provinces which include models of provincial/local/regional bargaining, as well as issues that have been split and bargained provincially/locally. She requested that if possible a summary of the results be provided for Trustees. Human Resources Committee (Open) 2 1 June 1998 (W In response to a question from Trustee Libbey regarding teacher salaries and the Foundation and Teacher Experience and Qualification Grants, the Director advised that copies of the updated Student Focused Funding Technical Paper issued by the Ministry of Education and Training will be circulated. 5. New Business In response to a question regarding the Chair's meeting with the Minister, Trustee Scott advised that a press release summarizing the meeting has been issued and that human resources issues were not discussed. She noted that a further report will be made at the next Board meeting. 6. The meeting subsequently adjourned at 11:20 p.m. Andrew Lam .Chair Human Resources Committee Human Resources Committee (Open) 3 1 June 1998 S© To Board for approval 8 June 1998 ANNEX 1 OTTAWA- CARLETON DISTRICT SCHOOL BOARD POLICY 054.HR TTTLE: WORKPLACE SAFETY AND INSURANCE Date issued: Revised: Authorization: Board Next review: 06 /2001 1.0 OBJECTIVE To ensure the Board's compliance with its obligations as an employer for reporting and recording all workplace accidents and injuries and to provide a fair and consistent approach to rehabilitation for its employees who have been injured on the job. 2.0 POLICY 2.1 The Ottawa - Carleton District School Board shall ensure compliance with the obligations placed upon it by the Workplace Safety and Insurance Act 1997, specifically to: a) ensure that employees report all workplace accidents as soon as possible, and seek appropriate treatment for personal injury or disease arising out of or in the course of employment; b) keep records of all workplace injuries (including those requiring first aid only) and report to the Workplace Safety and Insurance Board (WSIB) all workplace injuries requiring health care treatment, or resulting in health care treatment with time lost from work; C) perform workplace accident investigations objectively without placing blame or causation, to assist in establishing the root cause of accidents and take corrective action to help in the prevention of further work - related incidents or accidents; d) establish regular contact with injured employees, the WSIB, health care professionals, and workplace supervisors, in accordance with the provisions of the Workplace Safety and Insurance Act (the Act); e) re- employ all employees recovering from occupational injury or disease as soon as medically acceptable, according to the provisions of the Act; f) implement a modified work plan to assist injured employees who are temporarily unable to return to the regular duties of their pre -injury job, to return to appropriate employment with the ultimate goal of returning injured employees to their pre -injury employment whenever possible; and g) enhance the mandate to protect and maintain a safe and healthy working environment, incorporating the principles of workplace safety and protection from loss of earnings. -4- gl. 3.0 REFERENCE DOCUMENTS The Education Act , as amended, Section X The Workplace Safety and Insurance Act, 1997 (Formerly the Ontario Workers' Compensation Act, R.S.O.1990, c, W. 11) Ontario Occupational Health and Safety Act, R.S.O.1980, c. 321 Board Policy P.000.XXX: Health and Safety -5- To Board for approval 8 June 1998 F] To Board for approval 8 June 1998 Q� ANNEX 2 U OTTAWA - CARLETON DISTRICT SCHOOL BOARD POLICY P.058.HR TITLE: HEALTH AND SAFETY Date Issued: Last Revised: Authorization: Board Next Review: 06/2001 1.0 OBJECTIVE To provide and maintain a safe, healthy working environment for all Ottawa - Carleton District School Board ( OCDSB) staff and students. 2.0 POLICY 2.1 The Board is committed to the health and safety of all staff, students and other authorized occupants of Board property. 2.2 The health and safety of staff and students shall take precedence over expediency. Injury, illness and loss prevention shall be an operational responsibility which may (W require decisions at the highest management level of the Board. 2.3 The protection of staff from injury, illness or other losses are major obligations and important priorities of the OCDSB. Pursuant to the Occupational Health and Safety Act, all staff shall be encouraged to take every reasonable precaution to prevent personal injury in the performance of their tasks and to assist in the provision and maintenance of safe facilities. 2.4 Where health, safety, environmental and other related legislation and attendant regulations have been proclaimed by the Province of Ontario, the Board shall institute a health and safety system together with the necessary checks to verify the effectiveness of the system, including but not exclusive of the following: a) training to ensure that staff are competent to perform their respective tasks; b) provision of health programs to disseminate the latest developments in health and safety and disease prevention; C) a reporting system whereby injury trends can be recognized and analyzed for preventive measures; d) inventories of chemicals and other hazardous materials which exist in Board buildings; and e) establishment of a health and safety representative or committee for each building so that health, safety and environmental issues throughout the OCDSB can be addressed or directed to the appropriate agency. 3.0 SPECIFIC DIRECTIVES 3.1 In order to carry out the above obligations and provide assistance to all staff in carrying out their respective responsibilities, the Board shall establish a Health and Safety -6- To Board for approval 8 June 1998 Department whose duties encompass the continuing health, safety and environmental issues under the legislation. 32 The Director of Education shall cause a Joint Health and Safety Committee of staff to be formed. 3.3 The Director of Education is authorized to issue such procedures as may be necessary to implement this policy. 6.0 REFERENCES Ontario Occupational Health and Safety Act R.S.O. 1980, c. 321 Procedure PR.000.XXX IE PI SE
