HomeMy WebLinkAboutPR 633 HR - Eligibility For Enrolment In OMERS Pension Plan -1- PR.633.HR PROCEDURE PR.633.HR TITLE: ELIGIBILITY FOR ENROLMENT IN THE ONTARIO MUNICIPAL EMPLOYEES RETIREMENT SYSTEM (OMERS) PENSION PLAN Date issued: 21 November 2001 Last revised: 19 June 2018 Authorization: Senior Staff: 22 August 2001 1.0 OBJECTIVE To establish the rules of eligibility for enrolment of administrative and support staff employees into the Ontario Municipal Employees Retirement System (OMERS) pension plan, as required by the OMERS Act, R.S.O. 2006. 2.0 DEFINITIONS 2.1 Category of employees defines an employee's status in order to determine the appropriate eligibility criteria for enrollment in OMERS pension plan. 2.2 Continuous full-time (CFT), as defined by the OMERS Employer Administration Manual, is an employee who fills a continuing full-time position with the employer; regularly works the employer’s normal full-time work-week, defined as no less than 32 hours per week; and regularly works 52 weeks of the year. 2.3 Dual Membership may occur when a member is employed by, and enrolled in, OMERS, with more than one employer at the same time. Dual membership may also occur where a member works in two positions for the same employer. 2.4 Eligibility criteria, in accordance with the OMERS Employer Administration Manual, determine when an employee becomes eligible to be enrolled in the OMERS pension plan. 2.5 Mandatory enrolment is the process wherein the Employer is required to enroll employees in OMERS as a condition of employment from the date of hire as defined by the criteria in the Pension Benefits Act (PBA). 2.6 Other than continuous full-time (OTCFT), as defined by the OMERS Employer Administration Manual, is any employee who does not meet the definition of CFT. 2.7 Voluntary enrolment is the process wherein the employer must offer membership in OMERS to any employee who becomes eligible as defined by the criteria in the Pension Benefits Act (PBA). -2- PR.633.HR 3.0 RESPONSIBILITY 3.1 The Superintendent of Human Resources and the Superintendent of Financial Services 4.0 PROCEDURES 4.1 The Superintendent of Human Resources will be responsible for ens uring that all eligible employees are enrolled in OMERS. 4.2 The Superintendent of Finance will be responsible for ensuring that all employees enrolled in OMERS have the appropriate contributions deducted from their earnings and that the annual reporting of me mber information is completed in accordance with the OMERS Employer Administration Manual. 4.3 Procedures for Enrolment in OMERS 4.3.1. Mandatory Enrolment: Continuous Full-Time Employees (CFT) Eligibility Criteria: Compulsory enrolment upon effective date of hire 4.3.2 Mandatory Enrolment: Other Than Continuous Full Time Employees (OTCFT) Eligibility Criteria: Compulsory enrolment upon effective date of hire Employee Group Regular Work Year/ Minimum Regular Hours of Work Educational Support Professionals (ESP) 12 months and less than 32 hours per week and at least 17.5 hours per week 10 months, 10.5 months, or 11 months and 35 hours or less per week Term employees hired to fill a term position of 10 consecutive months or more Plant Support Staff Unit (PSSU) 12 months and less than 32 hours per week 10 months and 20 or more hours per week Term employees hired to fill a term position of 10 consecutive months or more Professional Student Services Personnel (PSSP) 10 months (paid over 12 months) and 35 hours or less per week Term employees hired to fill a term position of 10 consecutive months or more Employee Group Regular Work Year/ Minimum Regular Hours of Work Educational Support Professionals (ESP) 12 months and 32 hours or more per week Plant Support Staff Unit (PSSU) 12 months and 32 hours or more per week Union-Exempt 12 months and 32 hours or more per week -3- PR.633.HR Employee Group Regular Work Year/ Minimum Regular Hours of Work Student Support Professionals (SSP) 10 months and 35 hours or less per week Term employees hired to fill a term position of 10 consecutive months or more Union-Exempt 12 months and less than 32 hours per week 10 months, 10.5 months, or 11 months and less than 35 hours per week Term employees hired to fill a term position of 10 consecutive months or more Note: Employees in groups not referenced above are considered Other Than Continuous Full-Time Employees who are eligible for Voluntary Enrolment (see 4.3.3). 4.3.3 Voluntary Enrolment: Other Than Continuous Full Time Employees (OTCFT) applies to any employee who does not meet the mandatory enrolment requirements for any of the employee groups as def ined in 4.3.1 or 4.3.2 of this Procedure. Eligibility Criteria: Voluntary enrolment, if during each of the two immediately preceding calendar years, the employee has met one of the following criteria: (a) the employee has worked at least 700 hours, (including overtime) with any participating employer; or (b) the employee has earned, including overtime and vacation pay, at least 35% of the Year's Maximum Pensionable Earnings (YMPE) with any participating employer. 5.0 REFERENCE DOCUMENTS Ontario Pension Benefit Act Canadian Income Tax Act Ontario Municipal Employees Retirement System (OMERS) Act, R.S.O. 2006 Ontario Municipal Employees Retirement System (OMERS) Employer Administration Manual Board Policy P.006.HR: Delegation of Authority - Human Resources
