HomeMy WebLinkAboutPR 553 HS - Student Or Visitor Accidents - Insurance And Reporting -1- PR.553.HS PROCEDURE PR.553.HS TITLE: STUDENT OR VISITOR ACCIDENTS - INSURANCE AND REPORTING Date issued: 19 August 1998 Last revised: 14 July 2011 Authorization: Senior Staff: 18 June 1998 1.0 OBJECTIVE To outline the process for reporting on student or visitor accidents and injuries which occurred while at school or other District sites, or while engaged in school-related activities. 2.0 DEFINITIONS In this procedure, 2.1 Critical injury refers to an injury of a serious nature that: a) places life in jeopardy; b) produces unconsciousness; c) results in substantial loss of blood; d) involves the fracture of a leg or arm but not a finger or toe; e) involves the amputation of a leg, arm, hand or foot but not a finger or toe; f) consists of burns to a major portion of the body; or g) causes the loss of sight in an eye. (Occupational Health and Safety Act, Regulation 834) 3.0 RESPONSIBILITY 3.1 Superintendents, Principals, Vice Principal, Site Administrators, the Program Manager, Safety and Emergency Preparedness. 4.0 PROCEDURE 4.1 The District is committed to maintaining and safeguarding the health and safety of students, staff and visitors who enter onto District property or are engaged in District or school-related activities. -2- PR.553.HS 4.2 Notwithstanding the above, and recognizing that accidents can occur, the District maintains personal liability insurance through the Ontario School Board Insurance Exchange (OSBIE) to protect staff and the District against claims arising out of an alleged negligent act or failure to act which results in bodily injury or property damage to students or visitors. 4.3 The District will encourage parents to consider purchasing student accident insurance to protect against unforeseen expenses arising from accidents at school or during school related activities notwithstanding the best efforts of staff to create a safe environment. Specifically, the District will, on an annual basis, make information regarding student accident insurance from external insurance providers available to parents/guardians for their voluntary consideration. 4.4 Principals must ensure that parents/guardians complete and sign designated consent forms for school-related activities, including, but not limited to: field trips, excursions, educational tours and exchanges, Co-operative Education, and sports programs. Once signed and submitted, the consent forms will be retained at the school for two years after the collection date. Procedure PR.518.SCO “Field Trips, Excursions, Educational Tours and Student Exchanges” outlines the requirements in terms of the handling and disposition of these forms. 4.5 In the case of an accident or injury involving a student or visitor, the Principal/Site Administrator, (or designate) will: a) ensure appropriate first aid is being or has been administered in accordance with the District’s first aid program, including, where necessary, contacting emergency services (911). b) in the case of a student injury, at the first possible opportunity, contact the parents/guardians to inform them of the accident and injury. c) at the first reasonable opportunity and not later than 24 hours following the incident, complete the electronic online OSBIE Incident Report Form fully and objectively and submit it to OSBIE. The online Incident Report Form can be found on OSBIE’s website at www.osbie.on.ca. Injuries requiring only first-aid (i.e. no other medical attention) do not need to be reported to OSBIE. Where there is any doubt as to the severity of the injury, the Principal/Site Administrator or designate must complete and submit a report to OSBIE. 4.6 In the case of a fatality or critical injury or one involving hospitalization of a student or visitor, the Principal/Site Administrator, (or designate) will immediately inform: a) the appropriate supervisory officer, who will immediately inform the Director of Education or designate and the appropriate trustee; b) OSBIE by telephone; and c) the Program Manager, Safety and Emergency Preparedness 4.7 The Program Manager, Safety and Emergency Preparedness will notify the Ministry of Labour (MoL) in the event of a fatality or a critical injury. -3- PR.553.HS 4.8 The Principal/Site Administrator (or designate) will maintain a record of incidents reported to OSBIE in an in-school/site log which records only the name of the injured student, or visitor and the date the report was forwarded to OSBIE. 4.9 In the event of pending or actual litigation, a Principal/Site Administrator or designate will notify the appropriate supervisory officer, the Board’s legal counsel and the Program Manager, Safety and Emergency Preparedness. The Program Manager, Safety and Emergency Preparedness will: a) ensure that appropriate senior staff and other staff directly involved are advised of any developments in individual cases; and b) make whatever arrangements may be necessary for meetings and consultations concerning the matter. 5.0 ATTACHMENTS Attachment A – Process flow map for student and visitor injury reporting 6.0 REFERENCE DOCUMENTS District Policy P.064.HS: Student Accidents - Insurance and Reporting Occupier’s Liability Act, R.S.O. 1990 -4- PR.553.HS Attachment A – PROCESS FLOW MAP FOR STUDENT AND VISITOR INJURY REPORTING Incident occurs at school/site or during a school-related activity resulting in injury to student or visitor.
